1. Acceptance
These Terms & Conditions ("Terms") are an agreement between you and QUALSO TECHNOLOGIES PRIVATE LIMITED ("QUALSO", "we", "us"). They cover your use of the GigEngine Short User, GigEngine Short Partner, GigEngine User and GigEngine Partner apps and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. About the platform
GigEngine is an online marketplace. It connects customers looking for services ("Users") with independent workers and service professionals ("Partners"). QUALSO acts only as a technology platform and intermediary:
- QUALSO does not provide the services offered by Partners, and does not employ or act as an agent for Partners.
- Any agreement for work, including its scope, timing and price, is made directly between the User and the Partner.
- Payment for the work is made directly between the User and the Partner. QUALSO does not collect, hold or guarantee these payments.
3. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- You must register with a valid mobile number and give accurate, complete and current information.
- You are responsible for keeping your account secure and for all activity on it. Do not share your one-time passwords or login details.
- Each person may hold only one account per app, unless we allow otherwise.
4. Verification
To keep the platform safe, we may ask you to verify your identity with a government-issued ID (for example Aadhaar, PAN, Driving Licence, Passport or Voter ID). Some features may be available only to verified accounts. Verification confirms the details of the document you provided. It is not an endorsement or background check, and it is not a guarantee of anyone's skills, conduct or reliability.
5. Users
- You may browse Partners, send contact requests ("handshakes"), post job requirements and publish ads in line with these Terms.
- Job posts and ads are reviewed before publication. We may reject or remove content that breaks these Terms.
- Contact details revealed after a request is accepted may be used only to arrange the service. They must not be used for spam, harassment or any other purpose.
- Before engaging a Partner, use your own judgement about their suitability, including skills, references and safety.
6. Partners
- You are an independent service provider, not an employee or agent of QUALSO.
- You set your own rates, working days and hours. You are solely responsible for the quality, safety and legality of your services, and for any taxes, licences or permits they require.
- Keep your profile, services, rates and availability accurate and up to date.
- To be listed for a service category, you may need an active service plan for that category.
- Treat customers with respect, and do not ask for payment outside the agreed terms.
7. Fees and payments
- We charge platform fees for certain features. These may include contact reveal fees, job post fees, ad fees, optional homepage placement, User memberships and Partner service plans.
- All fees are shown in Indian Rupees (INR) in the app before you pay, and include applicable taxes unless stated otherwise.
- Payments are processed by our payment partner, Razorpay. By paying, you also agree to Razorpay's terms.
- Memberships and service plans are valid for the period shown at purchase. They must be renewed after expiry to continue the benefits.
- We may change our fees or introduce new ones. Changes do not affect plans you have already paid for.
- Refunds are governed by our Refund & Cancellation Policy.
8. Content you post
You are responsible for all content you post, including profile details, photos, job posts, ads, videos, ratings and reviews. You confirm that you have the right to post it and that it is accurate and lawful. You grant QUALSO a non-exclusive, royalty-free licence to host, display and distribute it within the Services, for as long as it is on the platform.
9. Prohibited conduct
You must not:
- Provide false information, impersonate anyone, or use someone else's identity documents
- Post content that is illegal, misleading, offensive, discriminatory, sexually explicit or violent, or that infringes anyone's rights
- Offer or request services that are illegal, or that involve child labour or forced labour
- Harass, threaten, abuse or defraud other users
- Use contact details obtained through the platform for spam or unrelated marketing
- Scrape, copy, reverse-engineer or disrupt the Services, or try to bypass fees or security measures
10. Suspension and termination
We may suspend, restrict or terminate your account, or remove your content, if we reasonably believe you have broken these Terms or the law, or put other users at risk. You may stop using the Services and delete your account at any time.
11. Disclaimers and limitation of liability
- The Services are provided "as is" and "as available". We do not guarantee that they will be uninterrupted or error-free, or that any particular Partner will be available.
- QUALSO is not responsible for the services provided by Partners, or for the conduct of any User or Partner, on or off the platform. Any dispute about the work itself is between the User and the Partner.
- To the maximum extent permitted by law, QUALSO's total liability for any claim relating to the Services is limited to the platform fees you paid us in the 3 months before the claim.
- We are not liable for any indirect, incidental or consequential loss.
12. Intellectual property
The GigEngine and QUALSO names, logos, apps, software and website content are owned by QUALSO TECHNOLOGIES PRIVATE LIMITED and protected by law. You may not use them without our written permission.
13. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable consumer protection laws, the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute arising from these Terms or the Services. Before going to court, please contact us so we can try to resolve the issue amicably.
